§ 42-2. Landfills.

  • (a)

    Short title. This section may be cited as the "Landfill Ordinance of the City of Alton, Texas."

    (b)

    Scope and purpose. In the interpretation and application, the provisions of this section shall be deemed to be prohibit all landfill operations within the corporate limits of the city without a valid permit from the state commission on environmental quality as required by applicable provision of federal, state, county, or city statute, ordinance, rules, regulations, codes, or other applicable criteria. The purpose of this section is to protect and promote the health, safety, and general welfare of the citizens of the city and vicinity.

    (c)

    Prohibition. The operation of a landfill and/or dump operation within the corporate limits of the city without the proper state permit is prohibited. This section does not prohibit the disposal of tree limbs and brush at the site designated by the city in the vicinity of the Mayberry Caliche Pit for final disposal by burning under a valid burn permit issued by the city fire department.

    (d)

    Penalty for violation. Any person, firm or corporation found in violation of the provisions of this section shall be guilty of a misdemeanor. Each and every truckload of debris, garbage, refuse, or other waste material, excluding tree limbs, deposited at an unlicensed landfill site will constitute a separate violation or offense.
